Condiciones Generales de Uso

1.1 Platform overview

The KARAVEL platform (the "Platform") is operated by KARAVEL SARL (AU), a single-member Moroccan limited liability company with share capital of MAD 100,000, registered in Casablanca (the "Company" or "KARAVEL").

The Platform is accessible at www.karavel.ma and via the KARAVEL mobile app on iOS and Android.

1.2 Platform role

KARAVEL acts solely as a commercial intermediary between duly authorised rental providers (the "Rental Companies") and users (the "Users" or "Customers").

KARAVEL does not perform the rental activity. The Platform enables comparison, booking and online payment. The rental contract is concluded directly between the Rental Company and the Customer; KARAVEL is not a party to it.

1.3 Definitions

• Platform: www.karavel.ma and the KARAVEL mobile app, including all related features and services.
• User: any individual or legal entity accessing the Platform, whether registered or not.
• Customer: any User completing a booking via the Platform.
• Rental Company / Provider: any partner rental company duly authorised to operate in Morocco.
• Booking: an order validated by the Customer for the rental of a vehicle.
• Account: the personal space created upon registration.
• Terms of Use (TOU): this document.
• Terms of Sale (TOS): the terms governing booking transactions, complementary to the TOU.

Access to and use of the Platform are subject to prior, unreserved acceptance of these Terms. By accessing the Platform, the User acknowledges reading and accepting them in full.

When creating an Account or making a Booking, the User must tick a box certifying that they have read and accepted the Terms of Use, Terms of Sale and Privacy Policy.

KARAVEL reserves the right to amend the Terms at any time. Substantial changes are notified to registered Users via email or in-app notification.

3.1 Account creation

Registration is free. The User provides: last name, first name, valid email, phone number and a password.

The User undertakes to provide accurate, complete and up-to-date information. Inaccurate information may lead to suspension or deletion of the Account.

3.2 Account security

The User is solely responsible for keeping their credentials confidential. Any use of the Account is deemed to be made by the User.

In case of unauthorised use or suspected breach, the User must inform KARAVEL immediately at contact@karavel.ma.

3.3 Age requirements

Registration is reserved for adults (18+) or duly represented legal entities. To book a vehicle, the Customer must be at least 21 years old and hold a valid driver's licence for at least 2 years (unless the Rental Company's specific terms differ).

3.4 Suspension and deletion

KARAVEL reserves the right to suspend or delete an Account in case of breach of the Terms, fraud, misuse or harm to the Platform, without prejudice to damages.

4.1 Services

• Search engine comparing offers by location, dates, vehicle type and budget.
• Detailed vehicle pages: photos, descriptions, equipment, conditions and verified reviews.
• Secure online booking.
• Secure payment by Moroccan card (CMI) or international card (Stripe).
• Customer area for tracking bookings.
• Customer service before, during and after the rental.
• Verified review system after each rental.

4.2 Availability

KARAVEL strives to keep the Platform available 24/7, without guaranteeing an absence of interruption (maintenance, force majeure, third-party events).

KARAVEL may temporarily suspend access for maintenance or updates, informing Users where possible.

KARAVEL acts as a commercial agent and technical intermediary. It connects Customers and Rental Companies and facilitates the transaction but is not a party to the rental contract.

• The Rental Company is solely responsible for the service: vehicle condition, compliance, insurance, maintenance, on-board documents.
• The Rental Company is solely responsible for its legal obligations (ministerial approval, insurance, technical inspection).
• KARAVEL is not liable for disputes between Customer and Rental Company after vehicle pick-up (damage, accidents, breakdowns, overcharging).
• KARAVEL does not guarantee the completeness of information provided by Rental Companies.

KARAVEL nonetheless offers a mediation service in case of dispute and will use all reasonable efforts to resolve the matter.

• Use the Platform in accordance with its purpose and the Terms.
• Do not use it for illegal, fraudulent or rights-infringing purposes.
• Provide accurate and complete information when registering and booking.
• Present a valid driver's licence compliant with the Rental Company's requirements at pick-up.
• Do not publish abusive, defamatory, discriminatory or unlawful content.
• Do not bypass security, payment or booking systems.
• Do not contact Rental Companies off-platform to avoid commission.
• Do not use bots or scripts to scrape data.

7.1 KARAVEL content

All Platform elements (text, images, graphics, logos, source code, design, database) are the exclusive property of KARAVEL or its partners, protected under Moroccan law and international conventions.

Any reproduction, representation, modification or exploitation without prior written authorisation is strictly forbidden and constitutes infringement.

7.2 User content

By posting reviews, comments or photos, the User grants KARAVEL a non-exclusive, free, worldwide licence for the legal protection term to reproduce, display, adapt and distribute this content across the Platform and KARAVEL's media.

The User warrants they hold all necessary rights and do not infringe third-party rights.

7.3 Trademarks

The KARAVEL trademark, logo and all figurative marks displayed on the Platform remain the exclusive property of KARAVEL. Any unauthorised use is prohibited.

8.1 Publishing reviews

Only Customers who have actually completed a rental may post a review. A satisfaction survey is sent 24 hours after the rental ends.

Reviews must be honest and reflect a real experience. They must not contain abusive, defamatory, discriminatory content, third-party personal data or advertising.

8.2 Moderation

KARAVEL reserves the right to moderate, edit or remove any review that does not comply, without notice. Rental Companies have a right of reply.

Reviews reflect only the author's personal opinion and do not engage KARAVEL's liability.

Within the limits permitted by Moroccan law, KARAVEL's liability is limited as follows:

• KARAVEL is only liable for the technical operation of the Platform and the intermediation service.
• KARAVEL is not liable for the acts, omissions or negligence of Rental Companies, nor for vehicle quality.
• KARAVEL is not liable for indirect damages, loss of profit, loss of data, moral or chance damages.
• KARAVEL's total liability shall not exceed the commission actually collected for the relevant booking.
• KARAVEL is not liable for interruptions, technical errors, viruses or force majeure events.

KARAVEL collects and processes personal data in accordance with Moroccan Law 09-08 on the protection of individuals with regard to the processing of personal data.

The processing has been declared to the CNDP.

Detailed conditions are described in the Privacy Policy, an integral part of these Terms.

Users have rights of access, rectification, objection and deletion, exercised at privacy@karavel.ma.

The Platform uses cookies to improve experience, measure audience and personalise content. A consent banner is shown on first visit.

Users may configure cookies via their browser or the Platform's dedicated module. Refusing certain cookies may limit features.

The Platform may contain links to third-party websites. KARAVEL has no control over these sites and disclaims all liability for their content or practices.

Linking to the Platform is permitted without prior consent, provided it does not harm KARAVEL's image. Deep linking and framing are strictly prohibited without written authorisation.

13.1 Governing law

These Terms are governed by and construed in accordance with Moroccan law.

13.2 Mediation

In case of dispute, the parties shall endeavour to resolve the matter amicably. The User may submit a claim to contact@karavel.ma. KARAVEL undertakes to respond within 15 business days.

13.3 Jurisdiction

Failing amicable settlement, any dispute shall be submitted to the exclusive jurisdiction of the Commercial Court of Casablanca, subject to consumer public-policy rules.

KARAVEL is not liable for non-performance due to a force majeure event as defined by Moroccan law and case-law: natural disasters, epidemics, wars, strikes, generalised network failures, governmental decisions.

15.1 Severability

If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force.

15.2 Entire agreement

These Terms, together with the Terms of Sale and Privacy Policy, constitute the entire agreement between the User and KARAVEL.

15.3 Waiver

KARAVEL's failure to exercise a right shall not constitute a waiver of that right.

15.4 Assignment

KARAVEL reserves the right to assign these Terms and related rights to any third party (merger, acquisition, asset transfer). The User shall be informed.
